The Lahore High Court on Thursday issued orders to shift two brothers to orphanage and put restriction on their meeting with anyone, observing that their uncle and employee seemed to deprive them of their precious property.
The judge also rebuked the Shalimar SHO for being a silent spectator, saying forgery was being committed in his vicinity but he had taken no action against the accused.
The judge ordered him to register a case against the grabber of proper, Iqbal, and submit progress report on the next date of hearing.
Justice Ijaz Ahmad passed the order while hearing a petition moved by Binyamin, who claimed to be the real uncle of the children but could prove it in the court.
The petitioner pointed out that Zainab, mother of Afaq and Ishaq, was a doctor and was running a hospital, Zainab Hospital. He said an employee of the hospital, Iqbal, had hatched a conspiracy to grab the precious property, adding he had tortured Zainab to death and grabbed the property.
He said Iqbal had moved a case in the civil court to transfer the property in his name. He had got an order after showing himself the real brother of the children, claiming that his mother Hafizan Bibi had married Ikhlaq, real father of the minors.
On Thursday, Iqbal’s counsel argued how petitioner-Binyamin could be real uncle of minors as he was Christen by religion whereas the children were Muslims.
He said, in the lower courts, Binyamin had showed himself the father of the children. However, Binyamin denied it, saying he had showed himself as guardian of the children as their father had abandoned him.
After hearing the arguments, the court observed that both the sides seemed to be hiding the facts to grab the property. |
